Protected whistleblower at the workplace

    Do you have an employee in your workplace who has been granted protected whistleblower status? Then please note that any legal action against a protected whistleblower with which he or she disagrees with you can only take with the approval of the Whistleblower Protection Office. 

    To request consent to an employment action against a protected whistleblower, you must submit an application that includes:

    • the employer's designation,
    • the name, surname, date of birth and residence of the protected whistleblower,
    • an indication of the employment action for which the employer is seeking the Office's consent (for example, dismissal),
    • justification of the need to carry out the employment act (the employer proves that the act is not related to the report),
    • annexes (employment contract, documents confirming the reasons for termination).

    How to apply:

    • by post in paper form to the address of the Office, signed by the applicant's handwritten signature,
    • electronically, with the applicant's qualified electronic signature, i.e. via the Central Portal of Public Administration slovensko.sk,
    • orally by prior agreement.

    Notice: The consent of the Office shall not be required where the employment act is an award of entitlement or an employment act relating to the termination of the employment relationship which is the result of a legal fact which does not depend on the employer's discretion.
